  1. Introduction

    These Terms of Service (the "Terms") govern your use of the Avela Experience Design website (the "Site") and any services or products offered through the Site (the "Services"). By using the Site or Services, you agree to be bound by these Terms.

    "Avela Experience Design" means the company Avela Experience Design, Inc., a California corporation. 
    "User" means any individual or entity that accesses or uses the Site or Services.

    Avela Experience Design provides a variety of services through the Site, including but not limited to:

    2. Development services 

    3. Consulting services

    Users agree to use the Site and Services in a lawful and appropriate manner. Users are prohibited from engaging in any of the following activities: 

    1. Posting or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. 

    2. Interfering with or disrupting the Site or Services. 

    3. Attempting to gain unauthorized access to the Site or Services. 

    4. Violating the intellectual property rights of others. 

  5. Job Alert Email Subscription and Contact Form Data

    Avela Experience Design may collect and store information provided by Users through email subscription forms and contact forms on the Site. This information may include but is not limited to:

    1. Name

    2. Email address

    3. Message content

      By submitting information through these forms, Users consent to Avela Experience Design's use and storage of this data for the purpose of email communication, job alerts, or responding to inquiries. Avela Experience Design is committed to protecting the privacy and security of this data and will not share it with third parties without User consent.

    Avela Experience Design may terminate a User's access to the Site or Services at any time for any reason, including but not limited to:

    3. Any other reason that Avela Experience Design deems appropriate. 

  9. Disclaimer of Warranties

    The Site and Services are provided on an "as is" and "as available" basis. Avela Experience Design makes no representations or warranties of any kind, express or implied, regarding the Site or Services. 

  10. Limitation of Liability

    In no event shall Avela Experience Design be liable to any User for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Site or Services, including but not limited to lost profits, lost data, or business interruption, even if Avela Experience Design has been advised of the possibility of such damages. 

  11. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws provisions.

  12. Entire Agreement

    These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
